Bailiff Service of Divorce Petition

Getting Divorced can be stressful especially when the Respondent fails to acknowledge the Divorce Petition.

If the court wasn’t able to deliver the Divorce Petition, they let you know by sending you a Notice of Non-Service of Petition. If the Divorce Petition is being ignored, then you may need to instruct a Bailiff to serve the Petition for you so you can prove to the Court the Divorce Petition has been received.

You could ask the Court Bailiff to serve the Petition for you. However, this can sometimes be a time consuming and the Bailiff is not always successful. Another option is to instruct a Process Server do serve the Petition for you.

The Process Server will need a copy of the Divorce Petition, Notice of Proceedings and a copy of the Acknowledgement of Service. A recent photograph of the Respondent is also helpful to assist with identification.

Once the Process Server has served the Divorce Petition for you, he or she will provide you with a Statement of Service as required under the Family Procedure Rules. This is your evidence the Divorce Petition has been served and you will need to lodge a copy of this with the Court to prove service.

The Bailiff cannot serve the Petition?

If the Court Bailiff is unable to serve the Divorce Petition for you, then you should receive a Notice of Non-Service. As far as we are aware they will not provide you with any other useful information.

How can a Process Server help me?

If a Process Server is unable to serve the Divorce Petition for you then he or she will provide you with a Statement of Attempted Service. This sets out all the efforts the Process Server has made to try and serve the Petition for you. It can then be filed at Court as evidence and you have the following choices:

  1. Apply for Deemed service;
  2. Make an Application for service by an alternative method (substituted Service) or at an alternative place; or
  3. Application to dispense with service.

We cost less than a Court Bailiff

Yes, that's right we charge less to serve a Divorce Petition than what the County Court Bailiffs charge! We provide low cost, Fixed fee Process Serving and will make multiple visits (usually up to three) to the one address.

Once the Divorce Petition is served, we will provide you with a Statement of Service or a Statement of Attempted service to assist you.

To instruct a Process Server

To instruct a Process Server you will need to post or email us the Divorce papers for service together with a further copy so we can exhibit this to our Statement of Service. A photograph or Description of the Respondent is also useful to help identify the person to be served.

Normally you would send us the Divorce Petition, Acknowledgement of Service and the Notice of Proceedings and a photograph to assist us.

If you don't have these documents then you will need to contact the Court where you issued the proceedings and ask them to sed you copies of what needs to be served. Tell the Court you wish to instruct a Process Server. The Court will also be able to confirm exactly what documents need to be served.
